On May 19, the Veteran's Employment and Training Service within the Department of Labor published a Final Rule regarding the report on veteran employees that government contractors must file annually.
The new regulations relate only to contracts entered into or modified on or after December 1, 2003. Employers with at least one Federal contract or subcontract of $100,000 or more will be required to file the VETS-100A report each year. These contractors must immediately begin collecting the information that will be required on the form. This means that covered employers should use the revised veteran categories when soliciting this information from their employees. The VETS-100A will first be due by September 30, 2009.
Contracts before the December 1, 2003 date will continue to be governed by the previous regulations meaning that some contractors will still be required to file the unrevised VETS-100. Some contractors may be subject to both sets of regulations. Such contractors will have to file both the VETS-100 and the VETS-100A.
