On December 3, 2007 the Equal Employment Opportunity Commission (EEOC) released a fact sheet regarding employment tests and selection procedures. The document discusses the interaction between federal anti-discrimination laws and employment tests and other selection procedures for screening applicants and promoting employees. The new fact sheet focuses on employer best practices for ensuring that all selection procedures are free of discrimination. It also draws upon recent EEOC litigation to show the wide variety in which selection procedures can introduce discrimination into the hiring process.
The EEOC acknowledges post 9-11 security concerns and the increased use of online job applications as reasons employers are utilizing a greater number of employment tests. There has also been a corresponding increase in the number of EEOC claims citing unfair selection tests and procedures over the past few years. |
